This Legal Notice and Terms of Use govern access to and use of the Casa Boutique del Mar website (casaboutique-delmar.com). 2. Real-estate registration and professional standing
Casa Boutique del Mar acts as a real-estate intermediary on the Costa Blanca. As a Valencian agency, we are entered in the Registro de Agentes de Intermediación Inmobiliaria de la Comunitat Valenciana (RAICV) under number 4431, the public register created by Decreto 98/2022, de 29 de julio, del Consell de la Generalitat Valenciana. We are also a member of APIAL (Asociación Profesional de Agentes Inmobiliarios de Alicante) under number A547.
Real-estate intermediation is not a regulated, chartered ("colegiada") profession in Spain in the sense of Article 10.1.d) LSSI, so the academic-title and professional-college disclosures required for regulated professions do not apply to us. We nonetheless publish, for transparency, the legally relevant public-registry datum (the RAICV entry) and our professional-association membership (APIAL). As a member of APIAL we observe the association's professional and deontological standards.
3. Purpose of the website and acceptance
This website presents Casa Boutique del Mar and its real-estate intermediation and related services (buying, selling, property management, renovations and lifestyle services), displays a selection of property listings for information, and lets you contact us through our forms, by email, by telephone and via the messaging and social channels we link to.
A "User" is any person who accesses, browses or uses this website. Accessing or using the website attributes the status of User and implies full acceptance of this Legal Notice and Terms of Use in the version published at the time of access. If you do not agree with them, please do not use the website.
The website does not offer user accounts, online payments or any e-commerce checkout. No transaction is concluded through the website; any engagement with the agency is arranged separately and, where applicable, formalised in a signed contract.
4. Property listings are indicative, not a binding offer
The information we publish about properties — including descriptions, photographs, prices, surfaces and measurements (m²), features, energy data, locations and availability — is provided for general information only and is merely indicative and orientative.
This information may contain errors or omissions and may be modified, corrected or withdrawn at any time without prior notice. It does not constitute a binding contractual offer ("oferta vinculante") and is to be understood as an invitation to make contact (invitatio ad offerendum), not an offer capable of acceptance, within the meaning of Articles 1261 and 1262 of the Spanish Código Civil. Binding terms arise only from a written contract signed between the parties.
Before making any decision, we recommend that interested parties independently verify the relevant data — for example with the Registro de la Propiedad (Land Registry), the Catastro, the cédula de habitabilidad and the energy performance certificate (certificado de eficiencia energética) — and obtain their own legal, tax and technical advice.
Prices shown for properties are indicative and, unless expressly stated otherwise, do not include taxes (such as IVA or ITP), notary, registry or other transaction costs, which are borne by the parties as provided by law and by the eventual contract.
5. Intellectual and industrial property
All content on this website — including texts, the design and layout, graphics, logos, the "Casa Boutique del Mar" name and brand, photographs, videos, icons and the selection and arrangement of content — is owned by the Owner or by third parties who have licensed it, and is protected under the Texto Refundido de la Ley de Propiedad Intelectual (Real Decreto Legislativo 1/1996, de 12 de abril) and, as regards distinctive signs, under the Ley 17/2001, de 7 de diciembre, de Marcas.
Property photographs are protected as photographic works or as "meras fotografías" under Article 128 of the Texto Refundido de la Ley de Propiedad Intelectual. The reproduction, distribution, public communication, transformation, extraction or any other use of all or part of the content, by any means, without the prior written authorisation of the Owner is prohibited.
Nothing on this website grants any licence or right over our intellectual or industrial property rights, other than what is strictly necessary to view the website and use its functions for personal, non-commercial purposes.
6. User obligations and acceptable use
You agree to use this website lawfully, in good faith and in accordance with this Legal Notice. In particular, you must not:
- use the website for any unlawful purpose or in a way that harms the rights or interests of the Owner or third parties;
- introduce or spread viruses, malware or any code that may damage the website, its systems or the Owner's CRM and infrastructure;
- attempt to gain unauthorised access to, interfere with, or disrupt the website, its servers or connected networks;
- scrape, harvest, copy, index or systematically extract listings, photographs, prices or other content or data from the website by automated or manual means;
- use property listings, photographs or content for unauthorised commercial purposes, including republishing them on other portals or websites;
- infringe the intellectual or industrial property rights described in these terms; or
- submit false, third-party or misleading personal data through our forms, or use them to send unsolicited communications.
7. Forms and contact channels
This website provides a general contact form, a "sell your home" form and a per-property enquiry form. These forms collect your first name, last name, email address, telephone number and a free-text message; the per-property enquiry also records which listing you are interested in. Submissions are sent to and stored in the agency's customer-relationship-management system (Tesoro CRM, operated by Tesoro Estate) so that we can respond to your enquiry.
How we handle the personal data you provide — the legal bases, the processors involved, your rights and retention periods — is explained separately in our Privacy Policy, which you should read before submitting any form.
The website also links out to external messaging and social channels (for example WhatsApp, Instagram, Facebook and LinkedIn) and to mapping and directions services. These are outbound links: using them takes you to a third party governed by its own terms and privacy practices, and they set no cookies on this website until you choose to follow them.
8. Third-party links and embedded content
This website may contain links to, and embed content from, third-party websites and services that we do not own or control. For information, property maps are shown using OpenStreetMap; on property-detail pages the map is loaded only after you click to activate it, so your browser does not contact OpenStreetMap's servers until you do.
We provide these links and embeds for your convenience and they do not imply any endorsement, association or guarantee. In line with Article 17 of the LSSI, we are not responsible for the availability, content, accuracy or practices of third-party sites and services to which we merely link, nor for any damage arising from their use. Your use of any linked or embedded third-party service is subject to that third party's own terms and privacy policy.
Details of the third-party services that may process technical data (such as your IP address) when you use the website — in particular our image-delivery network (Cloudflare Images) and the maps service (OpenStreetMap) — are set out in our Cookie Policy and Privacy Policy.
9. Limitation of liability
We take reasonable care to keep the website's information accurate and the service available, but to the maximum extent permitted by law we do not guarantee that the website will be free from errors or interruptions, or that its content is complete, current or fit for any particular purpose.
To the extent permitted by law, the Owner is not liable for: errors or omissions in the content (including the indicative property information described above); temporary unavailability, interruptions or technical faults of the website; or damage arising from the use of, or inability to use, the website.
Nothing in this Legal Notice excludes or limits any liability that cannot be excluded or limited under mandatory law, including consumer-protection liability under the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (Real Decreto Legislativo 1/2007, de 16 de noviembre) and the liability rules for information-society service providers in Articles 13 to 17 of the LSSI.
10. Privacy and cookies
The processing of personal data collected through this website is governed by Regulation (EU) 2016/679 (GDPR) and the Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD), and is described in detail in our Privacy Policy.
The use of cookies and similar technologies is governed by Article 22.2 of the LSSI and the Agencia Española de Protección de Datos (AEPD) Guía sobre el uso de las cookies, and is described in our Cookie Policy. This website uses only one strictly-necessary, first-party functional cookie (NEXT_LOCALE), which remembers your chosen language; it does not use analytics, advertising or third-party tracking cookies. Because the only cookie used is strictly necessary to provide a functionality you have requested (remembering your language preference), it is exempt from the prior-consent requirement of Article 22.2 LSSI under the AEPD's cookie guidance, and for that reason this website does not display a cookie-consent banner.
The Privacy Policy and the Cookie Policy are separate, dedicated documents and form part of this Legal Notice by reference. You can exercise your data-protection rights and, where you consider it appropriate, lodge a complaint with the AEPD at www.aepd.es.
11. Governing law and jurisdiction
This Legal Notice and Terms of Use, and any matter relating to the use of this website, are governed by Spanish law.
For disputes involving consumers and users, the competent court is the court of the consumer's place of domicile, in accordance with the applicable consumer-protection rules. Consumers cannot be required to submit to a different forum; any clause imposing another court on a consumer would be abusive and void under Article 90.2 of the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios.
For all other (non-consumer / business-to-business) relations, the parties, expressly waiving any other forum, submit to the Courts and Tribunals of Alicante, Spain.
If you are a consumer resident in the EU, you may also be able to use the European Online Dispute Resolution (ODR) platform under Regulation (EU) 524/2013, where applicable — primarily where a service has actually been contracted online. [To be confirmed: whether this ODR reference is retained, as no services are currently contracted through this website.]
